- Applicable Law means all applicable federal laws of Canada and the laws of the Canadian province or territory in which you reside or access the services, including gaming and consumer protection laws, and all applicable regulatory requirements (including AGCO/iGO standards in Ontario and MGA requirements for Malta-licensed operations).
- Parent Company means Super Group (SGHC) Limited, a company listed on the New York Stock Exchange (ticker: SGHC), which is the parent of certain Betway group entities, including Betway Limited and Cadway Limited, as publicly disclosed (for example via investors.sghc.com).
Account Registration
The Website itself may allow you to create an informational or community account (for example, to subscribe to updates or to post comments), and it may also include links that direct you to account registration processes on Third-Party Operator sites such as betway.ca and betway.com. The following rules apply:
Eligibility and Age Requirements
- Website access: You must be at least 18 years old and have legal capacity under Applicable Law to enter into these Terms in order to create any account on betway-game.ca.
- Real-money gambling: To open a betting or casino account with a Third-Party Operator and place Bets, you must:
- Meet the legal gambling age in your province or territory (typically 19+ in Ontario and several other provinces, and 18+ in some jurisdictions).
- Be physically located in a jurisdiction where the relevant Third-Party Operator is legally permitted to offer its services.
- Satisfy all eligibility criteria in that operator's own terms and conditions.
- Prohibited users: You must not use the Website or any Third-Party Operator services if it would be unlawful to do so under Applicable Law, and you must not use VPNs, proxies, or false information to circumvent geographic or age restrictions.
Account Creation and Verification
- Website accounts: If the Website offers registration:
- You must provide accurate, complete, and current information (for example, email address, username).
- You may be required to verify your email address or other details before your account becomes active.
- You are responsible for updating your details if they change.
- Operator accounts (KYC): When you register with Betway via betway.ca or betway.com:
- You will be required by the Third-Party Operator to complete "Know Your Customer" (KYC) verification, which may include government-issued photo ID, proof of address, and proof of payment method ownership.
- The Operator of betway-game.ca does not perform KYC for gambling accounts and does not have access to documentation you submit to Third-Party Operators.
User Responsibilities
- Accuracy: You warrant that all information you provide to the Website and to any Third-Party Operator is truthful, accurate, and not misleading. You must not impersonate any person or use details that do not belong to you.
- Security: You are responsible for keeping your login credentials confidential (including any passwords and multi-factor authentication). You must:
- Not share credentials with any other person;
- Use strong and unique passwords; and
- Notify the relevant service provider immediately if you suspect any unauthorized access.
- Single account policy: You must not create multiple accounts on the Website for abusive or deceptive purposes, and you must comply with any "one account per person" policies operated by Third-Party Operators.
Betting & Gameplay Rules
The Website does not accept Bets or provide real-money gambling. It provides information and links relating to Betway's licensed operations in Canada. When you choose to place Bets with Betway or any other Third-Party Operator via sites such as betway.ca or betway.com, the following general principles apply in addition to that operator's own rules:
Placing Bets and Wagers
- Offer and acceptance:
- A Bet is only valid once it has been accepted by the relevant Third-Party Operator and appears in your betting history or transaction log on the operator's site.
- Minimum and maximum stakes per market or game are determined by the Third-Party Operator and may vary by sport, event, game, or user profile.
- Types of bets: Third-Party Operators typically offer, subject to their rules:
- Sports bets (single, multiple, system, in-play);
- Casino games (slots, table games, live dealer games); and
- Other regulated products as allowed in the relevant jurisdiction.
- Irreversibility: Once a Bet has been accepted, you generally cannot cancel or modify it. Any exceptions (for example, "cash-out" features) are governed solely by the Third-Party Operator's terms.
Settlement, Void Bets, and Errors
- Official results: Bets are settled based on the official outcome of the relevant event or game, as determined by the Third-Party Operator's rules and the governing sports body or game provider.
- Voiding bets: A Third-Party Operator may void Bets in specific circumstances, such as:
- Obvious or material errors in odds or market configuration;
- Event cancellation or significant rule change; or
- Suspicion of fraud, match-fixing, or other integrity issues.
- Discrepancies: In the event of any discrepancy between information shown on the Website and the odds, rules, or results displayed on a Third-Party Operator's platform, the latter will prevail. The Operator of betway-game.ca is not responsible for settlement decisions taken by Third-Party Operators.
Conduct in Live Casino, Chats, and Community Features
- Respectful behaviour: Whether you interact via:
- Live casino chats operated by Betway or other Third-Party Operators; or
- Comments, forums, or feedback tools (if available) on betway-game.ca;
- Prohibited conduct: You must not:
- Use obscene, defamatory, discriminatory, hateful, or otherwise unlawful language;
- Promote illegal activity, including underage or unlicensed gambling;
- Attempt to collude with other players or share confidential information that could compromise game integrity; or
- Conduct any form of fraud, chargeback abuse, or money laundering.
- Moderation: The Operator of betway-game.ca and Third-Party Operators may monitor and moderate chats or user-generated content. They may remove content, suspend your chat access, or close accounts where necessary to protect other users, ensure regulatory compliance, or safeguard integrity.
Bonus Terms
The Website may describe or compare Bonuses and promotional offers available from Betway and other Third-Party Operators. All Bonuses are provided exclusively by those operators and are governed by their own promotional terms and regulatory obligations. The following principles generally apply:
Activation and Eligibility
- Opt-in and qualification:
- You may be required to opt-in to a promotion when registering or via your account on the operator's site.
- Bonuses may be subject to minimum deposit or qualifying Bet requirements, and may be restricted to new or existing customers in particular regions.
- Jurisdictional restrictions:
- In Ontario, any Bonus or "inducement" must comply with AGCO and iGO standards. Detailed promotional terms are usually available only once you are logged in to the licensed site (for example, betway.ca).
- In the rest of Canada, promotions offered via betway.com must comply with MGA rules and Applicable Law in your province or territory.
- Timeframes: Bonuses typically have expiry dates (for example, a bonus must be claimed or wagering requirements must be met within a specified number of days). The exact timeframes are set out in the Third-Party Operator's promotion-specific terms.
Wagering Requirements and Game Restrictions
- Wagering (playthrough):
- Bonuses are commonly subject to a wagering multiplier (for example, a multiple of the bonus amount and/or deposit).
- Until wagering is completed, withdrawals of associated bonus funds or winnings may be restricted.
- Game contribution: Different games may contribute differently towards wagering requirements (for example, slots may contribute 100%, table games a lower percentage, and some games may not contribute at all).
- Prohibited gameplay: Third-Party Operators may prohibit certain tactics when playing with Bonus funds, including:
- Placing very low-risk, minimal-variance Bets solely to clear wagering requirements;
- Hedging Bets across different outcomes to guarantee a profit;
- Abusing game bugs or technical loopholes; or
- Using multiple accounts or devices to exploit promotions.
Combining Promotions and Bonus Abuse
- Non-stacking rule: Unless explicitly permitted in the promotion terms, you should assume that Bonuses cannot be combined (or "stacked") with other offers at the same time.
- Real money vs. bonus money: Many operators apply real-money stakes before bonus funds. The precise order of fund usage and the treatment of winnings are governed by the operator's terms.
- Bonus abuse and consequences:
- Third-Party Operators may cancel Bonuses, remove winnings, and/or close accounts where they reasonably suspect abuse, fraud, or breach of their promotional rules.
- The Operator of betway-game.ca is not responsible for any decision by Betway or other Third-Party Operators to withhold or reclaim Bonuses.
Payments & Withdrawals
The Website does not process deposits, handle player funds, or execute withdrawals. All financial transactions relating to Bets and gaming are processed exclusively by Third-Party Operators, such as Cadway Limited (betway.ca) and Betway Limited (betway.com), under their own licences and banking arrangements.
Deposit Methods
- Available methods: Common payment methods offered by Third-Party Operators may include:
- Credit and debit cards (for example, Visa, Mastercard);
- Interac and other Canadian online banking/transfer methods;
- E-wallets and other digital payment services; and
- Bank transfers and other locally supported solutions.
- Limits and fees: Minimum and maximum deposit limits, as well as any transaction fees, are determined by the relevant Third-Party Operator and/or payment provider and will be displayed in your account cashier on the operator's site.
Withdrawals
- Verification: Before processing withdrawals, Third-Party Operators typically must verify your identity and, in some cases, your source of funds, in line with anti-money-laundering and regulatory obligations.
- Processing times:
- Withdrawal processing times vary by operator and payment method (for example, ranging from near-instant e-wallet payouts to several business days for bank transfers).
- Any timeframes indicated on the Website are informational only. The operator's cashier interface and terms prevail.
- Returned or failed payments: Chargebacks, failed deposits, or reversed payments may lead to:
- Temporary or permanent account suspension by the Third-Party Operator; and/or
- Adjustment or cancellation of associated Bonuses or winnings.
Refunds of Bets and Bonuses
- Bet refunds: Once a Bet is placed and accepted with a Third-Party Operator, it is generally not refundable. Refunds or voiding of Bets may occur only in specific circumstances defined in that operator's terms (for example, event cancellation or manifest error).
- Bonus refunds: Bonuses are usually non-withdrawable, and any removal, expiry, or forfeiture of Bonus funds is governed solely by the operator's promotional rules.
- Website role: The Operator of betway-game.ca:
- Does not hold or control your gambling funds;
- Cannot intervene in payment or refund decisions made by Betway or other Third-Party Operators; and
- Is not liable for delays, non-payments, or disputes relating to payments processed by those operators.
Limitation of Liability
Operator's Responsibilities
- Information accuracy: The Operator of betway-game.ca endeavours to provide accurate and up-to-date Content regarding Betway and related services, including licensing details (for example, the MGA licence MGA/B2C/130/2006 for Betway Limited) and third-party certifications (such as the eCOGRA "Safe and Fair" certification as at 2024).
- Technical integrity: The Operator uses reasonable technical and organizational measures to maintain the availability and security of the Website; however, uninterrupted or error-free operation cannot be guaranteed.
- Third-party fairness: While Betway and some other operators may be certified by independent organizations such as eCOGRA, such certifications are issued to those operators and their platforms, not to betway-game.ca. The Operator of the Website is not responsible for the fairness or performance of third-party games or systems.
Exclusions of Liability
- No liability for third parties: To the maximum extent permitted by Applicable Law, the Operator of betway-game.ca is not liable for:
- Any decisions, actions, or omissions of Betway, Cadway Limited, Betway Limited, Super Group (SGHC) Limited, or any other Third-Party Operator;
- Any losses arising from your use of betway.ca, betway.com, or other external sites, including financial losses related to Bets or Bonuses; or
- Any disputes between you and any Third-Party Operator, regulator (such as AGCO, iGO, MGA), or alternative dispute resolution body (such as eCOGRA).
- Technical issues: The Operator is not responsible for:
- Network failures, interruptions, delays, or incompatibilities;
- Data loss or corruption; or
- Viruses, malware, or other harmful components resulting from third-party systems beyond the Operator's reasonable control.
- Indirect losses: The Operator will not be liable for any indirect, consequential, punitive, or special damages, including loss of profits, revenue, data, opportunity, or goodwill, arising out of or in connection with your use of the Website.
Liability Cap
- To the extent that the Operator is found liable to you in connection with the Website, its Content, or your use of information that leads you to place a Bet with a Third-Party Operator, the Operator's total aggregate liability shall be limited to the lesser of:
- The total amount (if any) you have paid directly to the Operator for use of the Website in the six (6) months preceding the event giving rise to the claim; and
- The total amount of the single Bet or Wager that is specifically and directly related to the claim, but not exceeding the amount of that Bet.
- Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under Applicable Law, including liability for certain intentional acts or gross negligence where such exclusion would be invalid.
Intellectual Property Rights
- Ownership of Website Content:
- All intellectual property rights in the Website and its Content (including the Betway section, text, graphics, design, layout, and underlying software) are owned by the Operator or its licensors and are protected by copyright, trademark, and other laws.
- The "Betway" name and associated logos are trademarks or registered trademarks of their respective owners within the Betway group and are used on the Website for identification and informational purposes only.
- Limited licence:
- The Operator grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Website for your personal, non-commercial use in accordance with these Terms.
- You may not reproduce, distribute, publicly display, sell, rent, lease, sublicense, modify, adapt, translate, decompile, reverse engineer, or otherwise exploit any part of the Website or its Content except as expressly permitted by Applicable Law or with the Operator's prior written consent.
- Prohibition on copying and scraping:
- You must not copy or scrape substantial portions of the Website (including reviews, odds comparisons, or bonus listings) for use on competing services or for any commercial purpose without written permission.
- User-generated content:
- If you submit reviews, comments, or other content to the Website, you grant the Operator a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and display such content on the Website and in related promotional materials, subject to Applicable Law.
- You warrant that you own or have the necessary rights to any content you submit and that it does not infringe third-party rights.
Privacy & Data Protection
- Privacy Policy: All personal information collected through the Website is processed in accordance with the Website's Privacy Policy, which is incorporated by reference into these Terms. You should review that policy carefully before using the Website.
- Applicable privacy laws: The Operator processes personal data in accordance with Applicable Law, which may include the Personal Information Protection and Electronic Documents Act (PIPEDA) and relevant provincial privacy statutes.
- Data sharing: The Operator may use third-party service providers (for example, analytics, advertising, or affiliate tracking services) and may share limited data with them as described in the Privacy Policy. The Operator does not receive or process your KYC documentation or detailed payment information submitted to Betway or other Third-Party Operators.
- Cookies and tracking: The Website may use cookies and similar technologies to improve user experience, measure performance, and attribute traffic to Third-Party Operators. You can manage your preferences through your browser settings and any consent tools provided on the Website.
Changes to Terms
- Right to modify: The Operator may amend or update these Terms from time to time, for example to reflect changes in Applicable Law, regulatory guidance, industry standards, or the services offered on the Website.
- Notification: Material changes will normally be notified by:
- Updating the "last updated" date at the top of these Terms; and
- Displaying a notice or banner on the Website and/or sending an email notification to registered users, where feasible.
- Acceptance of changes: The revised Terms will become effective upon posting (or on any later date specified in the notice). By continuing to access or use the Website after the effective date, you are deemed to have accepted the updated Terms.
- Disagreement with changes: If you do not agree with any updated Terms, you must stop using the Website and, if applicable, close your Website account. Your use of betway.ca, betway.com, or other Third-Party Operator sites will remain subject to those operators' own terms and conditions.
Termination & Suspension
- Termination by the Operator: The Operator may, at its reasonable discretion and without prior notice where legally permitted, suspend or terminate:
- Your access to the Website (in whole or in part); and/or
- Any account you may hold on the Website;
- You have materially breached these Terms or any applicable policies;
- You have used the Website for unlawful, abusive, or fraudulent purposes; or
- Such action is necessary to comply with Applicable Law, regulatory requests, or to protect the integrity or security of the Website.
- Effect of termination: Upon termination:
- Your right to access and use the Website will cease;
- Any licences granted to you under these Terms will terminate; and
- The Operator may delete or anonymize any associated account information, subject to legal retention requirements.
- No impact on Third-Party Operator accounts: Termination of your access to betway-game.ca does not, by itself, affect any accounts you may hold with Betway or other Third-Party Operators. Those accounts are governed by the relevant operator's own terms, including their own suspension or closure rules.
- Termination by you: You may terminate your relationship with the Operator at any time by:
- Closing any account you hold on the Website (if such functionality is provided); and
- Ceasing all use of the Website.
- Survival: Provisions of these Terms which by their nature should survive termination (including, without limitation, Intellectual Property, Limitation of Liability, Governing Law & Jurisdiction) shall continue in full force and effect.
Governing Law & Jurisdiction
- Governing law: To the maximum extent permitted by Applicable Law, these Terms and any dispute or claim arising out of or in connection with them or the Website shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any conflict of law rules.
- Jurisdiction: You agree that the courts of Ontario shall have non-exclusive jurisdiction over any dispute or claim arising from or relating to these Terms or the Website, subject to any mandatory provisions of consumer protection or other Applicable Law that require proceedings to be brought in another jurisdiction.
- Disputes relating to Betway and other operators:
- Disputes concerning Bets, Bonuses, account balances, or game outcomes on betway.ca, betway.com, or any other Third-Party Operator site must be raised directly with that operator in accordance with its complaints procedure.
- For Ontario players, additional support and complaint mechanisms may be available via iGaming Ontario player support and the AGCO.
- For players using Malta-licensed services (such as Betway Limited under licence MGA/B2C/130/2006), dispute resolution options may include submitting a complaint to the operator's appointed alternative dispute resolution provider (for example, eCOGRA) and/or the Malta Gaming Authority, in line with the operator's terms.
- The Operator of betway-game.ca is not a party to your contractual relationship with Third-Party Operators and cannot adjudicate or settle such disputes, but may, at its discretion, cooperate with regulators or ADR bodies.
